Terms of Service

These Terms of Service ("Terms") govern your use of thundercat.io (the Site), app.thundercat.io, and related Thundercat services operated by Thundercat, Inc. ("Thundercat," "we," "us," or "our"). Requests to engramhq.com and app.engramhq.com redirect to those hosts.

By using the site or services, you agree to these Terms. If you do not agree, do not use them. How we handle personal information is described in the Privacy Policy.

1. Eligibility

• You must be at least 18 years old.
• If you use Thundercat on behalf of a company, you confirm you have authority to bind that company, and "you" includes that company.

2. The services

Thundercat provides a GTM engineering system and related websites, waitlists, demos, and (when you become a customer) hosted product access. Features may change as we develop the product. We may modify or discontinue parts of the services with reasonable notice when practical.

3. Accounts and access

• Keep credentials confidential. You are responsible for activity under your account.
• We may suspend or terminate access if we reasonably believe these Terms have been violated, or if needed to protect the service or other users.

4. Acceptable use

You agree not to:

• Use the services for unlawful, harmful, or deceptive activity.
• Probe, reverse engineer, or disrupt the site, product, or underlying models except as allowed by law.
• Scrape or overload the services with automated traffic without our written permission.
• Upload content you do not have the right to use, or that infringes others' rights.

5. Customer content and output

• You retain rights to data you submit ("Customer Content").
• You grant Thundercat a license to host and process Customer Content solely to provide and improve the services.
• To the extent allowed by law, you own output generated for you from your Customer Content. Similar output may be produced for others from their own inputs.

6. Intellectual property

The Thundercat name, mark, site design, and software are owned by Thundercat, Inc. These Terms do not transfer any ownership of our IP to you.

7. Payments

Paid plans, if offered, are billed in advance through our payment processor. Cancellations and refunds are described in the Refund Policy.

8. Disclaimer

The services are provided "as is" and "as available." We do not warrant that they will be uninterrupted, error-free, or that AI-generated output will be accurate or fit a particular purpose. You are responsible for how you use output in your business.

9. Limitation of liability

To the maximum extent permitted by law, Thundercat, Inc. is not liable for indirect, incidental, special, consequential, or lost-profit damages. Our total liability for any claim relating to the services will not exceed the amounts you paid us in the 12 months before the claim (or USD $100 if you have not paid us).

10. Governing law

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Courts located in Delaware will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

11. Changes

We may update these Terms by posting a new version on this page. Continued use after the updated date constitutes acceptance.
